As a victim of the Mass probate and family court I urgently call for our Governor to reform this lawless system which damages families and degrades the rights of parents statewide. This travesty of justice as soured the entire concept of marriage and undermines the core values of our families.
It turns one parent against the other for the benefit of the “system”. The judges are an integral part of the system and their conduct needs a serious and formal review process implemented. Their rulings have the ability to push parties to settle or allow continued battles. The attys. and the judges are PAID by this system of so called justice which generates by 2004 estimates some 175 BILLION dollars annually. The system extends to the jails and sheriff’s departments who administer the coercion and extortion. The rules are ever changing as the players within the system adapt ways to extend their reach. The system is biased against men. Men are turned into slaves, imprisoned, coerced and extorted for monies. Men are jailed EVERY day in Ma. for their inability to satisfy impractical settlement awards. The issues are nearly all financial in nature, however, the courts do not to apply one ounce of financial investigation or expertise in determining an ability to pay at given rate. Negative financial changes in circumstances for a father arising after a divorce are a mine field waiting to be stepped on. The subject father will be stripped of his rights, quite possibly incarcerated, have his drivers license revoked, and wages garnished to the point were he could not actually support himself.
Acts of incarceration are by far the most damaging and draconian of the courts tricks. This process is executed WITH due process or constitutional rights. The idea that a financial problem is made somehow better by locking up the wage earner is just ridiculous. The victim will typically loose his job, loose his place to live and become a non-functional member of our society. The classic judicial trick is one of extorting payment from the victim, then granting atty. fees to the ex-wife at the hearing. These are also demanded to be paid on the day of the hearing but may not have been anticipated, the poor father is incarcerated ANYWAY for atty. fees without the possibility of payouts over time as might be afforded. Awards of atty. fees are also positive feedback in this corrupt system that it perpetuates repeated court battles, especially where the woman has little downside risk.
The old ideals of marriage as our parents have taught us are gone. There are many people I have talked to who say that I “just got tangled up with the wrong person”. While this is a very true statement, all should be aware that the system WILL work hard to corrupt even the most honest ex-wife as to the possibility of more entitlements. This leads directly to a families destruction for the financial gains of the judges and atty’s. Personal contracts and agreements, insurance, and trusts may now replace the marriage vows. This eliminates the state involvement in our personal lives, especially where there are no children involved. I would predict that if the divorce system is starved for customers because of public awareness, it will adapt new laws to control and extort monies from couples without needing a marriage license. This trend has started in some US states already.
Not only have the rule books changed within the family and probate system, the Federal Bankruptcy system is now completely without protection for anybody divorced and unable to satisfy payments. 11 USC 523 A 15 has been totally disabled and offers NO protections whatsoever. Ironically it is with protection that resolutions are drafted. The changes in the Bankruptcy code will promote conflict without resolution.
